KidsCue Terms of Use
Last updated: October 13, 2026
1. Welcome to KidsCue
These Terms of Use ("Terms") are an agreement between you and Kids Cue LLC, a Nevada limited liability company ("KidsCue", "we", "us" or "our"). They govern your use of the KidsCue mobile application, the website at www.mykidscue.com, and our related content, features and services (together, the "Service").
By creating an account, starting a subscription, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read Section 4 (what KidsCue is and is not) and Section 5 (emergencies) carefully. Section 19 contains an agreement to resolve disputes through individual arbitration and a waiver of class actions. It explains how you can opt out within 30 days.
2. Definitions
- "You" means the adult who creates or uses an account.
- "Family Account" means an account shared by up to two adults and up to four children under one subscription.
- "Account Manager" means the adult who created the Family Account and manages the subscription.
- "Co-parent" means the second adult invited to a Family Account.
- "Child Information" means information about a child that you or your Co-parent enter into the Service.
- "Your Content" means everything you submit to the Service, including questions, descriptions, logs, reflections, feedback and content requests.
- "KidsCue Content" means everything we provide through the Service, including the library, articles, Quick Help cards, Words That Work phrases, courses, videos, audio and answers, whether written by our team or generated with the help of AI.
3. Who can use KidsCue
- You must be at least 18 years old and able to enter into a binding contract.
- You must be a parent, legal guardian, or a caregiver authorized by a parent or guardian to make everyday decisions about each child whose information you enter.
- The Service is for adults. Children may not create accounts or use the Service.
- The Service is offered in the United States.
- You may not use the Service if we have previously terminated your account for breach of these Terms, or if using it would violate applicable law.
4. What KidsCue is, and what it is not
4.1 What it is
KidsCue provides general educational information and practical suggestions about parenting and child development, matched to your child's age and the parenting approach you choose.
4.2 What it is not
KidsCue is not medical, psychological, psychiatric, therapeutic, educational-assessment or legal advice, and it is not a substitute for a qualified professional. In particular:
- It does not diagnose, treat, cure or prevent any condition, including ADHD, anxiety, developmental delays, or feeding or sleep problems.
- An ADHD status in the app is a label you choose in order to see relevant content. It is not a diagnosis, and we do not verify it.
- It does not give medication advice of any kind.
- Using KidsCue does not create a doctor-patient, therapist-client or any other professional relationship.
- If a professional who knows your child gives you advice that differs from KidsCue's, follow the professional's advice.
4.3 You decide
Every child and family is different, and you know your child best. Use your own judgment before acting on any suggestion. Do not follow a suggestion that seems unsafe or wrong for your child, and seek professional help whenever you are worried about your child's health, development, safety or wellbeing. We cannot promise any particular result.
4.4 Babies and infants
For babies, our content focuses on what the parent can do and on the environment around the baby. Never shake a baby. Contact a doctor, or call 911, right away if your baby has trouble breathing, has a high fever, is unusually drowsy or hard to wake, is not feeding, or if you are worried in any way. If you feel overwhelmed, place the baby somewhere safe, such as a crib, and ask someone for help.
5. Emergencies and safety
KidsCue is not an emergency or crisis service and is not monitored in real time. If a child or anyone else may be in danger, including a risk of suicide or self-harm, abuse or neglect, a medical emergency or violence, call 911 immediately or go to the nearest emergency room. You can also call or text 988 (Suicide and Crisis Lifeline), call the Childhelp National Child Abuse Hotline at 1-800-422-4453, or call Poison Control at 1-800-222-1222.
The Service automatically looks for signs of a crisis in messages so that it can show you emergency resources. This is a safety net, not a guarantee: it can miss a crisis, and it can flag a message that is not one. You remain responsible for recognizing and responding to emergencies. Our Privacy Policy explains how we handle detected events.
6. AI-generated content
- Most answers come from our pre-written library. Some answers are generated with the help of AI models provided by third parties.
- AI can be wrong, incomplete, out of date or unsuitable for your situation, and it may sound confident even when it is wrong. We apply safeguards, including library answers first, safety rules, crisis detection and review of AI answers by our team. These safeguards reduce risk but do not eliminate it.
- Evaluate every answer before relying on it, and please use the feedback buttons to tell us when something is wrong.
- You may not use the Service, or any output from it, to train or improve any other AI model.
- Our Privacy Policy explains how your information is used to generate AI answers.
7. Your account
- Provide accurate information and keep it up to date.
- Keep your password confidential and do not share your account. You are responsible for activity on your account, except activity that results from our failure to protect it.
- Tell us immediately at mykidscue@gmail.com if you suspect unauthorized access to your account.
- We may refuse or change a display name that is offensive or impersonates someone else.
8. Family Accounts and co-parents
- A subscription covers one Family Account: up to two adults and up to four children.
- The Account Manager may invite one Co-parent. By accepting the invitation, the Co-parent agrees to these Terms.
- Both adults can see and edit the Child Information and family activity in the Family Account, as described in our Privacy Policy. Invite only someone with whom you are comfortable sharing this information.
- The Account Manager can remove the Co-parent, and the Co-parent can leave, at any time. After removal, the former Co-parent no longer has access to the Family Account.
- The Account Manager is responsible for the subscription. If the Account Manager's subscription ends, paid features end for both adults.
- We do not resolve disputes between parents or caregivers, including custody disputes. If adults on a Family Account disagree about access, we may follow a valid court order, and we may suspend access to the Family Account until the matter is resolved. We are not responsible for the consequences of information shared with a Co-parent you invited.
9. Information about your children
By entering Child Information, you confirm that you are the child's parent or legal guardian, or are authorized by them to do so; that you have the right to provide the information to us for the purposes described in our Privacy Policy; and that it is accurate to the best of your knowledge.
Enter only what is needed. The Service asks for a child's first name or nickname, not a full name. Do not enter information about children who are not in your care, or more information about other adults than is necessary to describe a situation.
10. Subscriptions, free access and payments
10.1 Plans and prices
KidsCue offers paid subscriptions for a Family Account. Current plans and prices are shown in the app and on our website before you buy. As of the date of these Terms, the plans are Monthly at $12.90 per month, 3 Months at $32.90 every three months, and Yearly at $99.90 per year. Applicable taxes may be added.
10.2 Free access
New users can try the Service before paying, as described at the time of the offer. Currently, your first answer is free and no payment method is needed. We may change or end free offers for new users, and we may limit them to one per person, household or device to prevent abuse.
10.3 Automatic renewal
All subscriptions renew automatically at the end of each subscription period, for the same period and at the then-current price, until you cancel. You authorize the charge for each renewal to the payment method on file with the App Store or the payment processor you used. You will be told the price, the renewal period and how to cancel before you buy.
10.4 How to cancel
- Subscriptions purchased in the iPhone app are billed through your Apple ID. You can cancel at any time in your iPhone Settings, under your name, then Subscriptions. Cancel at least 24 hours before the end of the current period to avoid being charged for the next one.
- Subscriptions purchased on our website, if offered, can be cancelled at any time in your account settings or by emailing mykidscue@gmail.com.
- Deleting the app or your account does not cancel a subscription. Please cancel it as described above.
10.5 After you cancel and refunds
You keep access to paid features until the end of the period you have paid for. Refunds for App Store purchases are handled by Apple under Apple's policies, and you can request one through Apple. For purchases made directly with us, payments are non-refundable and we do not give refunds or credits for partial periods, except where required by law or as stated in these Terms.
10.6 Price changes
We may change subscription prices. We will notify you at least 30 days in advance, and the new price will apply from your next renewal after the notice period. If you do not agree, you can cancel before the renewal. Where the law or the App Store requires your consent to a price increase, we will ask for it.
10.7 Unlimited answers
"Unlimited answers" means we do not set a fixed monthly limit for normal personal use by the adults on a Family Account. To protect the Service, we may apply reasonable limits to prevent automated, abusive or commercial use.
11. Your Content
- You keep ownership of Your Content.
- You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt and display Your Content only as needed to operate, provide, secure and improve the Service, as described in our Privacy Policy. This license ends when Your Content is deleted from our systems, except for de-identified material that has been incorporated into our library as described in our Privacy Policy, and copies we must keep by law.
- If you send us suggestions, ideas or content requests, we may use them without any obligation to you.
- You are responsible for Your Content. Do not submit content that is unlawful, that you do not have the right to share, or that contains other people's personal information beyond what is needed to describe a situation.
12. KidsCue Content and our rights
- The Service and KidsCue Content, including text, articles, cards, phrases, courses, videos, audio, illustrations, software, and the KidsCue name and logo, are owned by us or our licensors and are protected by intellectual property laws.
- Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to use the Service and KidsCue Content for your own family's non-commercial use. You are welcome to use our phrases with your children and to tell a friend about a tip. You may not copy, republish, sell or distribute our content in bulk or include it in another product or service.
- We may change, add or remove content and features from time to time, for example to update content, comply with law or improve safety. If we remove a material paid feature, we will tell you, and you may cancel.
13. Acceptable use
You must not:
- use the Service unlawfully, or to harm, threaten, harass, exploit or endanger any child or person;
- enter false information about a child, or information about a child you are not authorized to represent;
- access or try to access another person's account or data, or bypass security measures, rate limits or access controls;
- copy, scrape, crawl or extract content or data from the Service by automated means;
- reverse engineer, decompile or disassemble the Service, except to the extent the law expressly allows;
- try to extract our prompts, training data or proprietary methods, or use the Service or its outputs to build a competing product or to train AI models;
- upload malware or interfere with the Service or its infrastructure;
- resell, sublicense or commercially exploit the Service; or
- impersonate anyone or misrepresent your relationship with a child.
If you are concerned about a child's safety, contact emergency services first, and then contact us at mykidscue@gmail.com.
14. Suspension and termination
- You can stop using the Service at any time and delete your account in the app settings or by emailing mykidscue@gmail.com from the email address on your account. Remember to cancel your subscription separately, as described in Section 10.4.
- We may suspend or terminate your account, or limit features, if you materially or repeatedly breach these Terms, if required by law, if your use puts a child or others at risk, or to protect the Service. Where reasonable, we will tell you why and give you an opportunity to fix the problem. If we terminate your paid subscription without cause, we will refund the unused part of the period you paid for.
- We may discontinue the Service with at least 30 days' notice, and we will refund prepaid fees for any unused period.
- Sections 6, 11, 12, and 15 through 21 survive termination.
15. Third-party services
The Service may link to or rely on third-party services, such as app stores, payment processors, emergency resources and video hosting. We are not responsible for third-party services, and their own terms and privacy policies apply to your use of them.
16. Disclaimers
To the fullest extent permitted by law, the Service and all KidsCue Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure; that any content, including AI-generated content, will be accurate, complete or suitable for your child; or that any particular outcome will be achieved. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
17. Limitation of liability
To the fullest extent permitted by law, KidsCue and its members, managers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or $100.
These limitations do not apply to liability that cannot be limited under applicable law, such as liability for gross negligence, willful misconduct, or fraud. Some states do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
18. Indemnity
If you use the Service in violation of these Terms or the law, or violate the rights of another person, and that causes a third party to bring a claim against us, you agree to defend, indemnify and hold harmless KidsCue and its members, managers, employees, contractors and agents from the resulting losses, liabilities and costs, including reasonable attorneys' fees, to the extent caused by your conduct.
19. Dispute resolution, arbitration and class-action waiver
Please read this section carefully. It affects your legal rights.
19.1 Informal resolution
Before starting any formal proceeding, please contact us at mykidscue@gmail.com with a description of your concern and the relief you seek. We will also contact you first if we have a dispute with you. Both sides agree to try in good faith to resolve the dispute within 60 days.
19.2 Agreement to arbitrate
If we cannot resolve a dispute informally, you and KidsCue agree to resolve any dispute, claim or controversy arising out of or relating to the Service or these Terms by final and binding individual arbitration, rather than in court. However, either party may bring an individual claim in small claims court if it qualifies, and either party may seek an injunction in court to stop the infringement or misuse of intellectual property rights.
19.3 How arbitration works
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. Unless you and we agree otherwise, it will take place by video conference or in the county where you live. The Federal Arbitration Act governs the interpretation and enforcement of this Section 19. The arbitrator may award the same individual relief that a court could award.
19.4 Costs
We will pay the AAA filing, administration and arbitrator fees that exceed the amount you would pay to file a claim in court, unless the arbitrator finds that your claim was frivolous or brought for an improper purpose. Each party pays its own attorneys' fees unless the arbitrator awards them under applicable law.
19.5 Class-action waiver
You and KidsCue agree that disputes will be resolved only on an individual basis. Neither you nor we may bring a claim as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and the arbitrator may not consolidate the claims of more than one person. If this class-action waiver is found to be unenforceable with respect to a claim, that claim will be decided by a court, not in arbitration.
19.6 Mass filings
If 25 or more similar demands for arbitration are filed against us by or with the help of the same or coordinated counsel, they will be administered in batches under the AAA's mass arbitration procedures, and the parties will cooperate in good faith to resolve them efficiently.
19.7 Your right to opt out
You may opt out of this agreement to arbitrate by emailing mykidscue@gmail.com within 30 days after you first accept these Terms. Your email must include your name, the email address on your account, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
19.8 Courts
Any dispute that is not subject to arbitration, or for which you have opted out, will be resolved exclusively in the state or federal courts located in Clark County, Nevada, unless you are entitled under the law of your state to bring the claim in your home county, and you and we consent to the personal jurisdiction of those courts.
20. Governing law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 19. This does not deprive you of the protection of any consumer protection laws of the state where you live that cannot be waived by contract.
21. Apple App Store terms
If you downloaded the app from Apple's App Store:
- These Terms are between you and KidsCue only, not Apple. KidsCue, not Apple, is solely responsible for the app and its content.
- Your license to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Apple has no obligation to provide any maintenance or support services for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are KidsCue's responsibility, to the extent not disclaimed in these Terms.
- KidsCue, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
- If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, KidsCue, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints or claims about the app should be sent to us at mykidscue@gmail.com.
- You must comply with applicable third-party terms, such as your wireless data service agreement, when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right to enforce them against you as a third-party beneficiary.
22. Changes to these Terms
We may update these Terms to reflect changes to the Service, our business or the law. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect, unless the change is required sooner by law or to address a safety or security issue. If you do not agree to the change, you can cancel and stop using the Service before it takes effect. If you continue to use the Service after the effective date, the updated Terms will apply to you. Changes to Section 19 will not apply to disputes that arose before the change took effect.
23. General
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right immediately, we have not given it up.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, provided that your rights are not reduced.
- Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.
- Notices. We may send notices to the email address on your account or through the app. You can send notices to us at mykidscue@gmail.com.
- Electronic communications. You agree that agreements, notices and other communications we provide electronically satisfy any legal requirement that they be in writing.
